Dear Miss Wood:
This is to acknowledge receipt of your letter dated
February 18, 1970, requesting information regarding
homosexuality and the law. The present law in Wiscon-
sin covers homosexuality by forbidding overt sexual acts
involving genitalia of members of the same sex, see
Section 944.17, Wisconsin Statutes. Wisconsin law also
prohibits public and indecent exposure of sex organs, Sec-
tion 944.20. There are other laws that may be found in
Chapter 944, Wisconsin Statutes, concerning sexual crimes
under the general category of crimes against sexual morality.
Disorderly conduct is the misdemeanor section of the
statutes most often used to charge and convict persons
accused of homosexual practices, Section 947.01.
Please bear in mind that the state makes criminal acts
between adults who engage privately in homosexual acts.
With this in mind many thinkers are recommending that
laws which interfere with private sexual conduct be abolished.
With this thought I have introduced in the last two sessions
of the legislature a bill which would permit parties to
privately engage in sexual behavior of their choice
provided these parties were of the age of consent.

Dear Mr. Harris:
Your letter of February 8 is flawless in its rhetoric,
but rather shallow in its sociological insight. As an argument
against political change it leaves much to be desired.
Phrases such as: "it has been shown throughout history,"
"it has certainly been shown," and "in every case of which I
am aware," come easily to mind, much more easily than any
evidence marshalled to bolster your case. Such evidence is
totally lacking in your letter.
Your one attempt to present evidence is a bit ludicrous.
If the increases in crime, welfare, and police were really
the result of the repeal of "morality laws," and if these
laws could really legislate morality, how easily our
problems could be solved. Where has it been shown that there
is a relationship between the repeal of fornication laws
and rape. The findings of most studies, including the
President's Commission on pornography, suggest there is no
relationship.
In fact, what we have learned from such ill-fated attempts
to legislate "morality" as Prohibition, marijuana, birth-
control, and women's rights, is that we can not legislate
morality. It is our changing society and our changing values
which are responsible for our changing morality. Changes in
our legal code are merely responses to these changes. These
responses must be made if our legal system is to remain
credible to the people.
On one point we are in agreement. Democracy does indeed
imply morality. However the type of morality required in
a democracy is implied in the golden rule. This is a morality
which is responsive to the rights and needs of one's fellow
human beings and fellow citizens. It seems to me that we
in this country have a great deal to learn about democracy.
If the strict and unbending application of the law
was the necessary and sufficient condition for moral
righteousness, we blacks would all be saints by now. Blacks
in this country have always been subject to harsher penalties
and stricter law enforcement than whites. Somehow it just
doesn't seem to have the effect you suggest.

Dear Mr. Barbee:
The government should attempt to improve the lot of the citizen. Your sug-
gestions for repeal of the so-called morality laws seems to seek the lowest
common denominator of citizen activity as a basis for establishment of law.
I suspect that it has been shown throughout the world and throughout history
that people with fewer laws are more barbaric. It has certainly been shown
that the first condition of democratic freedom is its limitation. Obviously,
either excessive limitation or a lack of limitation can destroy democracy.
Before morality laws are relaxed it should be shown that the change will
increase our freedom. The evidence seems to the contrary.
In every case of which I am aware, as such laws have been repealed the con-
trol of the state has increased. More welfare cases, more police action,
more court cases and higher taxes have been required for increased protection
of individuals from harm by others. The state is at least impersonal in its
sex activities. The rapist who is given an OK to force consent is not imper-
sonal. You must know that it is legally easier to decide on a fornication or
adultery offense than on a rape offense.
The only real excuse which I have seen for changes suggested is that our
judicial system is unable to handle the cases currently involved. I have
seen no reasons.
I hope that you will examine the psychological effects of law repeal on the
potentially criminal mind and the increased cost of law enforcement under
the new system before you encourage change.

Thank you for the copy of the Assembly Bill #3600, and the
press release comments. I am now making arrangements to
have one sheet summarys of the bill printed up so that we
can get the word out that NOW is the time to get behind
this bill and get it passed.
May 30th will work out well for me and the station to have
you appear in a live interview from 11:00 P.M. to midnight.
I would like to be able to rehearse with you for an hour
before we go on the air so that I can get some idea of the
type of responses you will make and what you would like to
get across about the bill. That means that we should meet
at the Station at 10:00 P.M. It is located at the corner
of Brown Deer Road and North 172nd (called Shady Lane in
Menomonee Falls) with the street address of 7348 North
Shady Lane.
My alternative date is Sunday, May 23rd, at 1:00 P.M. in
the U.W.M. Temporary Psychology Building where we have been
recording the program in room 142.
I prefer the May 23rd date so that we can take our time and
get the best interview. If you don't like your answer, we
can just stop and rerecord what you would rather say. It
is the easiest and safest way to interview. Doing it live
never gives one a chance to correct errors. Mr. Reitman,
the station program director, indicated he may well air the
tape a second time.
What can we do to help the passage of this bill? If there
will be public hearings by the Judiciary Committee, we of
the Gay Peoples Union of U.W.M. will come and testify.
Would public rallies be helpful? If so, we would like your
radio broadcast to be a keynote to such gatherings around
the area.

Dear Mr. Barbee:
I saw an article in the paper a week or two ago about a bill you are
introducing into the state legislature: one about removing the penalties
for sexual adventures in Wisconsin, and, I believe, also covering abortion
and birth control.
Could you please sned me more information, a copy of the proposed bill.
I would also be interested in knowing when a public hearing might be
scheduled for it.
This is not a field I have taken a great interest in, heretofore, being
a middle class mother of 6 children. However, I can appreciate the need
for your proposed bill. I believe I would support it enthusiastically.
I recently visited at Taycheedah and spoke with staff there and was
startled to find people incarcerated on "lewd" charges and other such.
Also, it does seem that many women do not have freedom of choice about
motherhood, or there would not be women in prison for child murder.
Also, it is clear from visiting Taycljeedah and from observing life around
this area and in Madison, human sexuality is not taken for granted as an
integral part of human nature, and your bill would certainly restore more
honesty to this whole question.

in crime rates when prohibition was repealed, I would like to have the
data. We subsidize the alcohol industry because of the increased need
for law enforcement and increased welfare costs when we repeal prohibition
laws at any level.
The morality laws influence human behavior, as do any other laws. The
Scandanavian countries have shown that with repeal of pornography,
fornication and related laws comes increased illegitimacy and more state
control. If you do not have these data, I can send you what I have.
Would you let me know of any information you have to the contrary?
I suspect that if you can present the ultimate outcome of morality law
repeal, that you can increase the support for these as they now stand.
Many people depend upon their government to let them know what the choices
are.

Dear Mr. Barbee:
As a compliment to you, may I say that rhetoric is indeed your specialty,
not mine. I only use it when I am sure that it will be understood. I
have been cautious on the morality laws question because I thought you
might have facts to support your position which were not available to me.
This does not seem to be the case since you continue via the news media
with a rhetorical basis for changes in law. As I said before, no reasons
have yet been presented to support your position.
I suspect that you want morality laws repealed because you feel that they
are disproportionately applied to Blacks. Do you have data to support
this? Can you show that they are not applied in proportion to the amount
of crime committed? If you have such data I will support direct efforts
on your part to protect the Blacks or any other similarly-treated group.
If, on the other hand, the Blacks are committing a disproportionate share
of crime, I will support disproportionate measures to help them rise above
the causal factors, namely: disproportionate educational opportunity,
disproportionate welfare treatment, disproportionate acceptance on a
personal basis. I am already a systematic contributor to the NAACP and
the Sharecroppers Fund and I can increase these contributions. There are
other ways that I can help.
The report of the President's Commission on Poronography is a biased
statement. Proof of this lies in their resistance to release their
data. As you probably know, Nixon's appointee had to threaten court
action before the Committee opened their findings to him. Any unbiased
group would have welcomed criticism of their findings. If you have other
data, I would like to know what they are. On the relation between repeal
of fornication laws and rape, I only claimed that it was easier to decide
on a fornication case than a rape case. Thus there is apt to be more
disproportionate law enforcement with rape cases than with fornication
cases.
The Civil Rights laws are the best example of legislation of morality
that I know of. Such legislation has put Blacks and Whites in such
positions that the Blacks have been able to prove their value, and the
judgement of Whites has changed. The decrease in the rate of lynchings
and KKK activity, at least, should support this observation.
Repeal of the prohibition laws brought increased government costs and
control. If you want me to provide specific data I can send them to you,
but I suspect that you are already aware of such findings. If you can find

RE: Assembly Bill 442, an act relating to reducing the age of consent
to 14 and abolishing criminal sanctions against certain consensual
sexual acts.
Members of the Committee:
The Wisconsin Civil Liberties Union is annaffiliate of the American Civil
Liberties Union, a nationwide, nonpartisan organization of more than 256,000 mem-
bers devoted to the protection of the Bill of Rights. More than 3,000 of these
members live in the state of Wisconsin. At the March 16 meeting of the state board
of the Wisconsin Civil Liberties Union, Assembly Bill 442 was discussed and the
following recommendations were made:
At this time, the Wisconsin Civil Liberties Union supports those portions of
Assembly Bill 442 which, one, decriminalize the involvement of consenting adults
in sexual acts and, two, define adults as persons of the age of 14 or older. Thus,
the Wisconsin Civil Liberties Union defines the age of consent as 14.
Of those two positions, the issue which our organization considers of higher
priority is the decriminalization of consensual sexual acts. The Wisconsin Civil
Liberties Union contneds that to define such acts as criminal is in violation of
the First, Ninth, and Fourteenth Amendments of the Constitution of the United
States.

There is more material available on the subject of homa
sexuality. No doubt you know that Time and Newsweek as
well as picture magazines like Look and Life have carried
articles recently. You can glean from such popular maga-
zines information on whether or not homosexuals are
ill, can be cured, etc.
It makes little sense to imprison convicted homosexuals.
More often than not, they see inmates practicing with
impunity the very acts for which they were incarcerated.

zens by harrassment, blackmail, jibes, job bias and

At the June 27 - July 1, 1975 General Synod Meeting of the United Church of Christ, a
biennual meeting of our denomination, delegates, without considering the rightness or
wrongness of same-gender relationships, voted to approve a document entitled, "A Pro-
nouncement on Civil Liberties without Discrimination Related to Affectional or Sexual
Preference." This document did not address the relationship of these people to our
Church but supported attaining their full civil rights.
Many members of Zion United Church of Christ in Milwaukee, do not agree with this action,
do not feel it represents the will of the individual churches or the majority of members,
and want to go on record of opposing enactment of laws which will remove present restric-
tions from homosexuals.
Since the document includes a requirement for sending a copy of the pronouncement to
State, and National governmental representatives, we feel we should notify you of our
opposing stand. To enable you to fully study the pronouncement and our related action
we are including the following items with this letter:

2. A condensed explanation sheet which points out what the Pronouncement did and did
not do.
3. Zion Church Statement (approved by a vote of 59 and opposed by 19 members at our
Annual Congregational Meeting, held October 19, 1975).

pent and refrain from all their sinful activities. In Christian love it is our
responsibility and obligation to work with and witness to all sinners. As a
Christian Church, we welcome all sinners who are seeking God's forgiveness and
grace. If they desire to become a member of the Church, first they must repent
and change their ways, then they could be properly received into membership.
The spiritual leaders of the Church MUST weigh these qualifications before ac-
cepting persons into the Church.
4. Do not accept the validity of ordination of homosexuals based on the standard
of Christian morals.
5. Consider it PROPER Synod activity to define a stand on the relationship of the
homosexual TO the Church, including ordination; consider it IMPROPER Synod ac-
tion to promote the civil liberties of homosexuals, which could lead to legal
status, without considering the rightness or wrongness of the moral issue in-
volved.
6. We believe the United Church of Christ promotion of this pronouncement will tend
to condone and give the Church's blessing to homosexuality and the ultimate le-
galization, thereof,
7. We believe the U.C.C. promotion of this pronouncement will lead to an increase
in this immoral practice and result in even greater casual acceptance by our
society.
THEREFORE ...
We, the congregation of Zion United Church of Christ, Milwaukee, Wisconsin:
1. Repudiate the pronouncement, reject this action and refuse to be bound by it.
2. Admonish the 11th General Synod in 1977 to rescind this pronouncement.
3. Strongly urge all other governing bodies and instrumentalities within the Church
at local State and National levels join in repudiating this action before the
General Synod of 1977.
4. Recommend that the Church at all levels address the subject of the relationship
of the homosexual to Church membership as well as ordination.
NOTE: We would appreciate hearing from individuals and congregations rwgarding their
response and action concerning this issue.

Affectional Preference" as passed by the 10th General Synod:
The Pronouncement DID:
1. Assume that the homosexual is presently UNFAIRLY oppressed.
2. State that the Church is wrong for supporting or allowing this ASSUMED
unfair oppression.
3. PROMOTE legal status for homosexual by attaining full civil liberties and
equal protection under the law, and calls upon CONGREGATIONS, Associations,
Conferences and Instrumentalities to work FOR civil liberties of homosex-
uals beyond what they have as citizens of the Amercian Society.
4. Authorize distribution of the pronouncement to respective STATE legislators
and CONGRESSIONAL representatives to inform then of the United Church of
Christ support for civil liberties for homosexuals.
The Pronouncement DID NOT (or attempt to):
1. Clain that the Scriptures support the Pronouncement.
2. Consider the rightness or wrongness of same-gender relationships. Did not
ask the homosexual to repent and change his/her ways.
3. Define the RELATIONSHIP between a homosexual individual and his/her Church
regarding membership, attendance, leadership, or activity participation.
4. Define the Church's stand on ordination of acknowledged homosexuals.
5. Show how homosexual activity is compatible with the fandly structure or
for the good of society as a whole.

A PRONOUNCEMENT ON CIVIL LIBERTIES WITHOUT DISCRIMINATION
RELATED TO AFFECTIONAL OR SEXUAL PREFERENCZ
"A Pronouncement is a declaration of Christian conviction on a matter of social principle,
approved by the General Synod and directed to the churches and to the public." (63 Gs 18)
The purpose of this pronouncement is to make a statement on civil liberties. It
is not within the province of this pronouncement to make an ethical judgment about same-
gender relationships. However, this pronouncement may well serve to further dialogue
that will clarify the ethical issues involved in human sexuality.
There is, in the United States, a significant minority of persons whose civil lib-
erties, and whose right to equal protection under the law, are systematically and toutinely
violated. Discrimination related to affectional or sexual preference in employment, hous-
ing, public accomodations, and other civil liberties, has inflicted an incalculable burden
of fear into the lives of persons in society and in the church whose affectional or sexual
preferences is toward persons of the same gender.
Most directly affected are the 10% of the population whose affectional or sexual
preference, according to the research of Alfred Kinsey, is predominately towards persons
of the same gender. Also affected is the one-third of the American population which Kin-
sey found to have had at one time or another an adult sane-gender sexual experience.
Public revelation of even a single experience often results in the presumption that a per-
son is same-gender-oriented and thus subject to social sanctions including violations of
her or his civil liberties. Even the civil liberties of persons whose affectional or sex-
ual preference is a well-guarded secret are vulnerable. Inquiry by private investigatory
agencies into the personal life of the individual is often a pre-requisite for employment.
Draft records, insurance investigations, arrest records (even when charges have been dis-
missed or the defendant acquitted), and investigations instigated on the basis of anony-
nous accusation or rumor, all provide an employer, landlord, and other persons information
used to justify discrimination.
DICRIMINATION CAUSES SUFFERING
A constant fear of losing one's job and hone, and the economic and social conse-
quences of such a loss, creates suffering in human life. Living as presumed heterosex-
uals, sane gendered-oriented women and men are intimidated into silence, forced into lives
of duplicity and deception, by the hostility of the majority society. Such duplicity and
deception, and their current alienation, sonetines evolving to isolation and depression
and culminating in suicide, are necessarily detrimental to the growth of the individual
and to the growth of inter-personal relationships. Today, sane-gendered-oriented persons,
our sisters and brothers in human community and in Christian community, are struggling to
free themselves from the fear which the reality of discrimination, particularly in en-
ployment and in housing, has inflicted upon then. Such persons are taking a moral stance
against discrimination and the violence that it does to human dignity. They seek to se-
cure protection for their full civil liberties and equal protection under the law. The
church must bear a measure of responsibility for the suffering visited upon sane-gender-
oriented persons since often the traditional Judeo-Christian attitude toward same-gender
relationship has been used as a primary justification for denial and violation of civil
liberties and the perpetuation of discrimination against such persons.
THE RELIGIOUS PERSPECTIVE
Christian love for God and our neighbor in God impels us to cherish the life and
liberty of all women and men. We proclain a unity under God which transcends our division,
and find in Christ our measure for being human.
As Christians, we seek to personify the liberating Gospel of Jesus the Christ and
to follow his example in our relationships with others. This means that we try to have
love and respect for each other -- for individual well-being, quality of life, personality,
dignity, and self-actualization.

RE:
Senate Bills 30 and 31 were introduced by the Legislative
Council at the recommendation of its Special Committee on Criminal
Penalties. The following explanations of the bills are from the
Legislative Council's Report to the Legislature on Proposals
Relating to Criminal Penalties.
1973 S.B. 30, Discretionary Commitment for Sex Crimes Offenders
Senate Bill 30 [LRB-932/1], amends s. 975.02, Wis. Stats., to
delete the present requirement that the Department of Health and
Social Services must give approval beiore a judge can commit a
person to the Department for a pretrial examination under the Sex
Crimes Law. Under the bill, the judge, who it is believed has the
best knowledge of the crime committed, would have the discretion as
to whether or not he will commit a person for such an examination.
Chapter 975 of the statutes, the Sex Crimes Law, requires in
s. 975.01 that persons convicted of certain enumerated sex crimes
shall be committed to the Department for a presentence social,
physical and mental examination. The enumerated crimes are: ss.
944.01, rape; 944.02, sexual intercourse without consent; and
944.11, indecent behavior with a child.
Section 975.02 of the statutes provides for discretionary
commitments if a person is convicted of any sex crime other than
those specified in s. 975.01. According to s. 975.02, "sex crime"
is any crime, except homicide or attempted homicide, in which the
court finds that the person was probably directly motivated by a
desire for sexual excitement in the commission of the crime.

The Special Committee felt that since a commitment under the
Sex Crimes Law is based upon a criminal conviction, the fact that a
person serves time in a sex crimes facility instead of a prison is
little reason to deny the person credit toward a concurrent or
consecutive sentence.

I can't imagine anyone cluttering up legislature with all of the immoral
bills you have proposed. You seem to have missed the point like so many
other people that the moral laws were set-up to protect mankind from its
own excesses which leads to destruction.
If your proposals were to go through which I do not think they would have
a chance of doing, what kind of a society would we have. The home would
be destroyed, disease would be rampant and society in general would de-

I can't imagine what kind of people you are trying to appeal to with your
suggested legislature. Why not spend your time thinking up legislature

Dear Mr. Barbee,
In a recent speech by yourself to the Assembly you said that
the sex act is not so much now an act of procreation as it is an act
done for "enjoyment and recreation". As I understand your logic,
from that premise you went on to say that this now justifies the
relaxation of restrictions by the state of both the act and its
consequences (conception). If I have correctly understood your logic,
it seems about as faulty and phony as a penny postcard.
It may be true that the sex act is basically done for endpy-
ment and recreation. This undoubtably has always been true, for
in the history of mankind sexual intercourse has always taken place
#hundreds of times more often than childbirth!! This is nothing new.
Even if there were a change in this, however, it does not make
it any more or any less a subject of government control. Most of
what I take part in for "enjoyment and recreation" is controlled
by law. My hunting and fishing is regulated, as is the driving
of my car and the beer I drink. In fact, at the present time,
the participation in sexual intercourse is less regulated than
any other "enjoyment and recreation"!!
And, I, for one, am getting sick and tired of paying for
this situation through higher health insurance rates to cover
abortion, unwanted births and venereal disease. And I'm getting
sick and tired of paying for looseness in the area of sex through
higher taxes to pay for skyrocketing welfare costs!
And I also am weary of an ever weakening moral fiber in our
society which makes our nation subject to collapse and my own
children tempted into an ever increasing hell on earth.
And then to top it all off, I have to pay the salaries of
legislators who want to further destroy morality and reverence
for life!!
I sincerely hope I have misunderstood your postition!
