Would your church support the following statement as a revision to
Wisconsin Law?
"It shall not be unlawful for organizations with clearly
defined moral and sexual philosophies who work with chil-
dren, to hire staff who support those philosophies."
At present it is illegal in Wisconsin to refuse to hire someone be-
cause they have different sexual beliefs or practices.
Wisconsin Employment Relations law, ER-43, passed in 1982, but only
this year being enforced by counties placing boys with us at Rawhide,
states as follows:
ER 43.01: It is the policy of this State to ensure equal
opportunity without regard to age, race, creed or reli-
gion, color, handicaps, sex, marital status, national
origin or ancestry, political affiliation, arrest or con-
viction record, or sexual orientation.
Section 111.32, par. 13m: "Sexual orientation" means
having a preference for heterosexuality, homosexuality,
or bisexuality, having a history of such a preference,
or being identified with such a preference.
In virtually all other areas of discrimination such as sex, na-
tionality, religion, etc., there are exemptions by federal law for
bona fide occupational need. Per Title VII of the Civil Rights Act of
1964:
TITLE VII CIVIL RIGHTS ACT, OCT., 1964, SEC. 703,
par. (e)(1): Notwithstanding any other provision of this
title, (1), it shall not be unlawful employment practice
for an employer to hire and employ employees on the ba-
sis of his religion, sex, or national origin in those
certain instances where religion, sex, or national ori-
gin is a bona fide occupational qualification reasonably
necessary to the normal operation of that particular
business or enterprise.

There are no federal or state exceptions for hiring based on
sexual orientation because the issue is not even recognized on
the federal level. Wisconsin is one of the first if not the first
State to enact such a law.
At this point let me say what we are not doing. We are not
opposing any specific sexual group, nor are we saying everyone
should espouse our moral philosophy.
We are saying this: Any program working with children (day care
centers, group homes, children's institutions, churches, etc.)
that teaches a specific moral philosophy should be able to use
staff (paid and voluntary) who support the program's moral
philosophies.
As an example Rawhide teaches that marriage should be a commit-
ment for life if at all possible, that marriage should be one man
- one woman, that sexual relations should be within the bonds of
marriage, etc. This is a fairly traditional philosophy that we
understand a lot of people no longer support, but we feel is im-
portant in our work of rebuilding the lives of children placed
with us by the juvenile courts.
Rawhide Boys Ranch is not and does not want to be a political
activist, but we believe this law as it stands is wrong. We are
willing to ask State legislators to submit an exemption, but it
would have little chance of passage without massive church and
other public support.
Our goal is to get at least 100,000 Wisconsin voters to back
this effort before legislation is introduced and then to let
those people know how to support its passage as it progresses
through the legislative process. Without united support success
would be doubtful.
We also want more input as to the proper wording of an exemption
statement, but at present propose a simple amendment such as we
have stated at the start of this letter.
Would your church as an organization support such an exemption to
ER-43? And will you assist us in gathering signatures and
addresses of Wisconsin voter support for such an exemption?
We will supply at no cost "explanation pamphlets" for bulletin
inserts or other distribution. Please return the enclosed order

Members of the Maine Civil Liberties Union have contacted my office to
ask that I share my thoughts with you about Wisconsin's experience in
non-discrimination legislation covering sexual orientation. I am happy to
do so, and hope that they will be useful to you as you weigh similar
legislation for Maine.
Wisconsin became the first state in the nation to include sexual
orientation as a protected category in its equal rights statute in 1982,
when the provision was signed into law by Governor Lee Dreyfus, my
predecessor. Although some critics predicted dire consequences at the
time, the existence of the "gay rights" category in Wisconsin's statute
has brought us no ill effects. To the contrary, I believe Wisconsin is
stronger today and in a better position to deal with problems like
Acquired Immune Deficiency Syndrome (AIDS) because the state has
offered specific protections to this substantial minority.
The Wisconsin law forbids discrimination in housing, employment and
public accommodations on the basis of sexual orientation, defined as
"heterosexuality, homosexuality or bisexuality" by preference, history or
identification. The category is excluded from the state's affirmative
action requirements.
The costs of administering the law have been very modest. Wisconsin,
with a population of 4.7 million, roughly four times that of Maine, has
had only 40 discrimination complaints filed with it under the sexual
orientation provision since 1982. None has gone to court. Several have
been settled in conciliation.
The Wisconsin reform was accomplished with bipartisan support.
Republicans and Democrats voted for it; a Republican governor signed it.
I, a Democrat, am implementing it. Our state Equal Rights Division
handles the complaints, and, since the law is so new, I have appointed a
14-member Governor's Council on Lesbian and Gay Issues to monitor its
implementation and advise me on associated issues of appropriate concern
to the state.

The Council has performed well. In addition to meeting with state agency
officials and holding public hearings in communities around Wisconsin to
learn of discrimination problems, it has conducted a survey on violence,
sponsored a health conference for lesbians and gays, and worked closely
with the Wisconsin State Medical Society to sensitize physicians to the
treatment rights and needs of homosexual patients.
The State of Wisconsin believes it is appropriate to be neutral on issues
of personal sexual orientation. We feel our criminal laws offer adequate
protection against sexual abuses by people of any sexual preference. Our
"gay rights" provision gives no special rights to anyone, but it gives
important security to law-abiding citizens for whom a serious problem of
discrimination has existed. It has helped to make Wisconsin a more
tolerant state and, I believe, a more attractive place to live.
Once again, I hope these thoughts will be helpful to you. I look forward
to seeing you personally at the NGA summer conference in Boise. The
State of Idaho will have to strain very hard to top the hospitality we
enjoyed in Portland two years ago.

Dear Governor O'Neill:
In 1982 Wisconsin passed legislation to protect the civil rights of
lesbians and gay men in our state. It is my understanding that Connecticut
is considering similar legislation in HB 7584, An Act Concerning
Discrimination on the Basis of Sexual Status.
Prior to the passage of our legislation, opponents made dire predictions
about what might happen if such a bill were passed. It was predicted that
gay teachers would proselytize in the classroom about their sexuality.
This has not happened. It was predicted that gay men and lesbians would
flock to Wisconsin, flaunting their lifestyle. This too has not
happened. What has happened is that we have stablished an effective tool
for combatting discrimination on the basis of sexual status.
Legislation such as HB 7584 has not done away with prejudice (as no
civil rights legislation does), but has achieved its intended purpose
of protecting the basic civil rights of those lesbians and gay men
who have been the victims of discrimination.
In closing, I would also add that my support of this bill has caused
me no negative political repercussions. Discrimination against
homosexuals does exist and, like any minority group, gay men and
lesbians need legislative protection..
I urge your support on this important civil rights issue.

support to Reps. Stolberg/Jaekle.
Since their organization was quite
specific about what was to be in our
letter, I asked that they send us a

The enclosed came out in the Advocate last week and thought you
would want to have.
At KRJB-FM Radio Station in Monte Rio, CA they are the first to
broadcast a regular Newscast from the National Gay Network in S.F. The story
was on AP/UPI Audio, KRON-TV and KSRO Radio in Santa Rosa....until Management
there killed it.
Monte Rio/Guerneville is in the heart of the Russian River Resort
A rea and thus far Gays and Straights are managing to get along. Leonard Matlovitch
the Air Force Sergeant (ex) hosts a weekly two hour call-in show on KRJB-FM
every Thursday at 8pm. His guests have included Paul Seideler of the S.F.P.D.
Community Relations Unit, former Monterey Deputy Sheriff Don Tombe who got beaten
up and who is now suing the City of Monterey and its Police Department for not
having allowed him to file charges against his Straight assailants.
And the S.F. Chronicle did a write-up on KRJB (half page) which
mentioned me by name. My boss in the National Guard, I am sure, read it but
so far no-one's said anything. I do get some curious looks from my colleagues
in the Public Affairs Section of the National Guard but I am told individually
by them that they "respect" me (whatever THAT means).
I am going out of my way to befriend those who, like myself, feel
i solated and who need some moral support to stand up for Human Rights. It gets
very lonely and it hurts a lot when hear of tales like Don Tombe's.
Well, I really just want to pass the enclosed along and to tell
you I'm glad you're around.

forts in helping to pass AB70, the statewide gay rights b
bill. This move shows a deep and genuine belief in equa-
lity of civil rights under the law. In a time when a
small group of people are trying to deny equal rights for
all people, you have stood up and showed everyone that
justice eventually does prevail. I take special pride in
the fact that it is Wisconsin, the state of my birth, that
has passed the first comprehensive statewide bill banning
discrimination on the basis of sexual orientation.

your latest efforts concerning the pending consensual sex

Dear Senator Carpenter:
I understand that there will be a public hearing on LD-1249, a proposal to extend
Maine's non-discrimination statutory language, to cover sexual orientation. My
understanding is that it is patterned after Wisconsin's law banning
discrimination in employment and housing because of sexual orientation, which
was created through Wisconsin Chapter 112, laws of 1981. (1981 AB-70) I would
encourage you and other committee members to look at Wisconsin's example and
record, and to act affirmatively on the proposal.
In a society which is founded on the principle of majority rule while respecting
minority rights, it is important to take steps to assure that people who have
experienced a history of physical and verbal threats, or job or housing
discrimination, be specifically protected by federal, state and/or local law.
Those in our society who are gay or lesbian may make up to ten percent of our
population. Yet the 5-10% of that group who ever identify themselves as such,
combined with many "closeted" homosexuals, bear the brunt of harassment and job
and housing discrimination. Much of U.S. society will not likely willingly
practice tolerance of people or groups that differ from themselves, especially
if historical misconceptions and prejudice are not confronted with enforceable
laws of a society. My belief is that individuals discriminated against are
treated as "second class citizens."
Between January 1982 and December 1984, there were 71 complaints of discrimination
based on sexual orientation that were filed with the Division of Equal Rights
of the Wisconsin Department of Industry, Labor, and Human Relations. A number

employees/renters, etc., learn about, and understand the law.
When the Wisconsin Legislature passed 1981 Assembly Bill 70, moderate Republicans,
including then Governor Lee S. Dreyfus, joined majority Democrats in passing
the legislation. No one has suffered political fallout as a result. I wasn't
in the Assembly at that time, but I have subsequently supported consenting adults
legislation. (1983 AB-250 [Act Number 17]). As a moderate Republican in a
rural, relatively conservative district, I have found that these measures can
be successfully defended on their merits, and without risking political suicide.
Non-discrimination legislation isn't a matter of pandering for special interest
votes. It's allowing some members of our society to take a more full measure
of the freedoms that are uniquely American, and enjoyed by most.

ALASKA GAY/LESBIAN RADIO SHOW RECEIVES JOURNALISM AWARDS
A gay/lesbian radio program in Anchorage, Alaska, is the
recipient of two Excellence in Journalism awards from the Society
of Professional Journalists, Sigma Delta Chi.
"Out in the North," a weekly public affairs program on
KSKA-FM, featured the winning entries during broadcasts in 1984.
Producer David McCartney received a second-place award in the
sports category for a feature profiling a lesbian softball team.
He and KSKA News Director Johanna Eurich also received a second-
place award in the documentary category for "She's Daddy's Girl,
Too," the story of a Fairbanks, Alaska, gay father who won joint
custody of his daughter following a divorce.
The awards were announced recently in Seattle.
Newspapers,
television and radio stations from a five-state region participated
in the annual competition.
Of the three awards to Anchorage radio stations, "Out in the
North" received two.
"This is exciting not only on a personal level, but also on a
professional level," McCartney said. "It demonstrates an awareness
and sensitivity of gay/lesbian issues on the part of professional
journalists who judged the entries."
"Out in the North" is produced by volunteers for Anchorage's
public radio station and is heard Sunday evenings at 8:30. The
program debuted as "Gay News Review" in 1978.

EXPLANATION OF WISCONSIN'S SEXUAL ORIENTATION LAW
At present it is illegal in Wisconsin to refuse to
hire someone because they have different sexual
beliefs or practices.
Wisconsin Employment Relations Law, ER-43, passed in
1982, but only this year being enforced by counties
placing boys with us at Rawhide, states as follows:
ER 43:01: It is the policy of this State to
ensure equal opportunity without regard to
age, race, creed or religion, color, handi-
caps, sex, marital status, national origin
or ancestry, political affiliation, arrest
or conviction record, or sexual orientation.
Section 111.32, par. 13m: "Sexual orienta-
tion means having a preference for hetero-
sexuality, homosexuality, or bisexuality,
having a history of such a preference, or
being identified with such a preference.
At this point let me say what we are not doing: We
are not opposing any sexual group or saying only
people of our belief should work with children, nor
are we saying everyone should espouse our moral
philosophy.
We are saying this: Each program working with chil-
dren (day care centers, group homes, children's in-
stitutions, churches etc.) that teaches a specific
moral philosophy should be able to use staff who
support those philosophies.
As an example Rawhide teaches that marriage should
be a commitment for life if at all possible, that
marriage should be one man one woman, that sexual
relations should be within the bonds of marriage,
etc. This is a fairly traditional philosophy that we
understand a lot of people no longer support, but we
feel is important in our work of rebuilding the
lives of children placed with us by the juvenile
courts. We believe it should be a bona fide occupa-
tional requirement that our staff support these phi-
losophies.

sion to Wisconsin's ER-43 Law?
"It shall not be unlawful for organizations
with clearly defined moral and sexual phi-
losophies who work with children to hire
staff who support those philosophies."
Rawhide Boys Ranch is not and does not want to be a
political activist, but we believe this law as it
stands is wrong. We are willing to ask State legis-
lators to submit an exemption, but it would have
little chance of passage without massive church and
other public support.
Our goal is to get at least 100,000 Wisconsin voters
to back this effort before legislation is introduced
and then to let those people know how to support its
passage as it progresses through the legislative
process. Without united support success would be
doubtful.
If you support our effort for an exemption to ER-43,
and are of voting age, please return this pamphlet
with your name and address. (If you will help us get
more support names, we will send as many pamphlets
as you can use.)
