effort to prevent state interference in the sexual choices of consenting
adults. I teach a course in marriage and the family, which includes
material on cohabitation, and have been pointing out to students for the
last four years the discrepancy between actual behavior and Wisconsin's
policies. I will be happy to change the punch line of my lecture on this
topic!

Dear Jim:
I understand the Consenting Adults Bill is up again. I do so
hope that you will reconsider your position on this Bill. At the risk of sound-
ing repetitious, let me say that I feel advocating sexual privacy does not
imply the government's approval of co-habitation or any sexual act, anymore
than the lack of laws requiring people to go to church on Sunday implies the
government is in favor of sleeping in on the Sabbath. It seems to me that if
the government has the right to tell people who they can live with and what
they can do in their own bedrooms, then the government should also start
telling people something even more important: everybody should go to church
on Sunday. Why don't we work on that, rather than telling people (including
husbands and wives) that they can't have any kind of sex other than coitus?
It seems to me worshiping God is a much more important issue.
Well, Jim, those are my thoughts. I'd be interested in hearing
your views, if you have time to respond.

I am writing to urge you to support passage of Assembly Bill 250,
the consenting adult bill, As you surely know, this bill, widely
supported by clergy, religious and law enforcement groups and
individuals, came within one vote of passage in the Assembly last
session. We cannot afford, I feel, to let it lose once again.
As the League of Women Voters of Wisconsin have said, "...the
current statutes are enforced in an arbitrary and capricious manner...
Aggressive enforcement of this lawas it applies to private acts of
consenting adults implies the necessity of gestapo-like tactics
and raises the questions of whether or not privacy rights would be
infringed by such enforcement."
I am sure this bill already has your support but I am writing to give
you constituent feedback, and to support your efforts on behalf of

sexual activity between consenting adults.
Analysis by the Legislative Reference Bureau
This proposal alters the coverage of certain crimes involving sexual
activity between consenting adults. Acts of fornication or sexual grat-
ification between consenting adults are not criminal unless they are per-
formed in public or for any thing of value. Such acts in public or with
consenting minors aged 16 or 17 or animals are covered under the crimes of
fornication and sexual gratification (formerly called sexual perversion),
as applicable. Sexual intercourse with a minor without consent (a minor
under 16 is incapable of giving such consent) is currently covered under
the sexual assault law. The crime of cohabitation is abolished, but
provisions prohibiting cohabitation if a person is still married are
retained.
Various references in the crimes concerning prostitution previously
referred to "sexual perversion". Those crimes still prohibit certain acts
of sexual gratification between consenting adults if the acts are done for
any thing of value. The proposal eliminates the authority to deny, sus-
pend or revoke a person's operating privilege on the basis of a conviction
for "sexual perversion".
The penalties for these crimes are not changed.
For further information, see the state fiscal estimate which will be
printed as an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly,
do enact as follows:

SECTION 1. 343.06 (11) of the statutes is amended to read:

343.06 (11) To any person who has been convicted of any offense
specified under ss. 940.225, and 944.12 and 944.17 or adjudged delinquent
under ch. 48 for a like or similar offense, when the sentencing court
makes a finding that issuance of a license will be inimical to the public
safety and welfare. Such The prohibition against issuance of a license to
said the offenders shall apply forthwith immediately upon receipt of a
record of such the conviction and such the court finding by the secretary,
for a period of one year or until discharge from any jail or prison sen-
tence or any period of probation or parole with respect to the offenses

public safety and welfare for the offender to have operating privileges.

prison or jail sentence or probation or parole with respect to the
offenses specified, whichever date is later. Receipt of a certificate of
discharge from the department of health and social services or other
responsible supervising agency shall, after one year has elapsed since

SECTION 3. 939.22 (24) of the statutes is amended to read:
939.22 (24) "Place of prostitution" means any place where a person
habitually engages, in public or in private, in nonmarital acts of sexual
intercourse,
sexual perversion gratification involving the sex organ of
one person and the mouth or anus of another, masturbation or sexual con-
tact for any thing of value.

SECTION 4. 944.15 of the statutes is repealed and recreated to read:
FORNICATION. (1) In this section, "in public" means in a
place where or in a manner such that the person knows or has reason to
know that his or her conduct is observable by persons other than the
person with whom he or she is having sexual intercourse.

Whoever has sexual intercourse in public or whoever has sexual
intercourse with a minor who is 16 years old or older but younger than 16
years old and who is not his or her spouse is guilty of a Class A
misdemeanor.

ISSUES & COMMENT
THE CONSENTING ADULTS BILL
BILL HISTORY: Identical legislation has been introduced the past two succes-
sive sessions of the legislature, both by the Assembly Committee on Criminal
Justice and Public Safety and the Senate Committee on Human Services (last
session by the request of over 40 groups, members of the clergy and district
attorneys). This bill has passed the Senate and failed passage in the Assembly
by one vote. Both former Governor Dreyfus and Governor Earl have indicated
support for this initiative.
SCOPE OF THIS LEGISLATION: Decriminalizes a limited number of private acts.
The bill:
1) Repeals the cohabitation statute, Wis. Stats. 944.20(3), with respect
to adults.
2) Adds the words "in public" to the fornication statute, Wis. Stats.
944.15.
3) Recreates the perversion statute as a sexual gratification statute,
adding the words "in public" to Wis. Stats. 944.17(1)(a).
4) Repeals that part of the drivers licensing statute, Wis. Stats.
343.30 (2) (d), making it no longer possible to deny a license due to
conviction under 944.17.
WHAT THIS BILL DOES NOT DO: Doesn't decriminalize any seuxal acts done for pay
(prostitution). This bill doesn't repeal the adultery statute. The current
laws on sexual assault continue to apply to all non-consenting sexual acts.
All sexual acts between an adult and minor (not the person's spouse) remain
criminal. Sexual activity with animals remains criminal.
NATIONAL SUPPORT FOR SEX LAW REFORM: Similar legislation has been enacted in
25 states, including Alaska, California, Illinois, Indiana, Iowa, Nebraska, New
York, North Dakota, Ohio, Oregon, Pennsylvania, South Dakota and Vermont. Many
other states have never had cohabitation statutes.
The model penal code of the American Bar Association contains no criminal
sanctions for private sexual acts between consenting adults, and recommends
their repeal where they do exist.
The AMERICAN BAR ASSOCIATION, the AMERICAN FEDERATION OF TEACHERS, the AMERICAN
MEDICAL ASSOCIATION, the AMERICAN PSYCHIATRIC ASSOCIATION, and the NATIONAL
ASSOCIATION OF SOCIAL WORKERS support the concept of decriminalization.

Many of the country's largest corporations, including AT&T, IBM, BANK OF
AMERICA, PROCTER AND GAMBLE, MCDONALD'S, HONEYWELL and CITICORP, have adopted
written policies that guarantee employes the right to privacy in their sexual
activity.
Three higher courts in the United States have found statutes prohibiting
sexual behavior between consenting adults to be an unwarranted invasion of
privacy under the U.S. Constitution -- in New Jersey, Pennsylvania and New
York. The New York Supreme Court at Rochester ruled that "Personal sexual
conduct is a fundamental right protected by the right of privacy because of the
transcendental importance of sex to the human condition, the intimacy of
conduct, and its relationship to a person's right to control his or her own
body."
WISCONSIN AND THE LAW: A 1977 study of the cohabitation statute by University
of Wisconsin Law Professor Martha Fineman shows that 73% of Wisconsin district
attorneys concurred that "cohabitation is not a matter which can or should be
addressed by criminal sanctions or the criminal justice system." Only 14.5%
thought cohabitation should be addressed by the criminal justice system.
Yet, each year Wisconsin adults are prosecuted for cohabitating and for sexual
acts performed in the privacy of their home. Last year, Clark Norton in an
article entitled "Sex in America: an Outlaw's Guide" stated that Wisconsin has
the national reputation as the "forerunner in the field of nabbing fornicators."
Some of the organizations that have endorsed the repeal of these archaic laws
are the UNITED MINISTRY IN HIGHER EDUCATION, LEAGUE OF WOMEN VOTERS IN WIS-
CONSIN, WISCONSIN WOMEN'S NETWORK, WISCONSIN COUNCIL ON HUMAN CONCERNS, WIS-
CONSIN FEDERATION OF TEACHERS, WISCONSIN CHAPTER OF THE NATIONAL ASSOCIATION OF
SOCIAL WORKERS, AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYES -
COUNCIL 24 and the MADISON POLICE DEPARTMENT.

Thank you for your recent comments on the State Democratic Party
Platform Committee's proposed priorities.
As you know, one proposed priority is the plank under the "Responsive
Government and Citizen Protection" heading which calls for "strengthening
legislation protecting citizens from invasion of privacy". While this
passage does not specifically mention the Consenting Adults bill, a broad
interpretation of the plank could be construed to include this issue
in my judgment. Therefore, if this passage is adopted by the committee
as a priority I will ask our Research and Roll Call Subcommittee
Chairperson to include the vote on this bill in the Democratic Roll Call.
The platform is a continuing document which is adopted bienially. That
means we will not be taking action on changing specific language until
the spring of 1984. Assuming you would like to see the platform
specifically mention the Consenting Adults bill, I would suggest that
you or a representative move such an amendment at the 2nd Congressional
District Convention at that time. All amendments that pass in district
convention are automatically considered for inclusion by the Platform
Committee. Given the current make-up of the committee, it would likely
be adopted as a new plank.
Another opportunity for you to get the party apparatus behind this bill
would be at this year's state convention, which will be held in Milwaukee.
A resolution in support of this measure could be introduced.

Dear Jan and Lary,
Thank you so very much for coming down to dinner with
me Wednesday night. As always the challenging discus-
sion was great fun for me. However, I am pained Le
cause Jan always wins out.
Really, I know how busy
you both are, so I do appreciate your accepting my in-
vitation on moments notice.
Enclosed is the list of members of the Horticulture Ad-
visory Committee at the University that you asked me
to send to you. As you see the list includes the biggest
growers, fruit, vegetables and nursery in the state.
The meeting was very well handled. We growers as oc-
iated with the young men of the faculty and extension.
I was heartened to see the enthusiasm and nigh morale
of the staff, from the Leans down to the graduate stu-
dents. Although there were several opportunities cur-
ing the session, none gave evidence of frustration over
the restricted Luget, salary or operating, such as the
newspapers would have us believe. I wish you could
have the time to visit Lean Lower and his laboratories
to see the fascinating projects they are working on
that bear on the future of agriculture in Wisconsin.

In times past in our discussions, we have voiced heavy
opinion against laws that are insensitive to present
conditions, and especially those that are unenforcille

on a universal basis. The present law is not being,
and cannot be enforced equally. It seems to me that
its dubious value is vitiated by its potentiality as
an entrapment instrument. Threats of public accusa-
tion or exposure have ruined many an able public fig-
ure as a result of despotic, and at times capricious
enforcement.
Today the availability of sophisticated electronic sur-
veillance equipment can often make a good citizen vul-
neralle tocharacter assassination.
One of the greatest privileges we Americans have over
citizens of the totalitarian countries is our consti-
tutional "Right to Privacy". I believe the import of
our present law invades this guarantee to privacy.
As you know, Lary, I write to you in this vein as a
private citizen, not part of a special interest group,
for my chances of being entrapped by the existing law,
at my age, are nil.
I do hope you will support the new ill.

enacting assembly bill 250, the consenting adults bill.
The Cohabitation law is outdated and not usually enforced, but under
a strong enforcement policy a significant percentage of the population
could be harassed and even arrested. I strongly feel what two adults
do in the privacy of their own home should be their business--not
the states.
As a constituent of yours, I would hope for a "yes" vote for AB 250
from you.

seems ridiculous in this day and age to
have such archaic statutes on the books,
which have very little to do with the way
things happen in contemporary society. It
results in general disrespect for the law
