In order to determine whether there is any arbitrary discrimination on the basis of race, religion, national origin, sex or, marital status or sexual orientation as defined in s. 111.32 (4s), examine and assess the statutes under which the head has powers or regulatory responsibilities, the procedures by which those statutes are administered and the rules promulgated under those statutes. If the department or agency head finds any such discrimination, he or she 7 8 shall take remedial action, including making recommendations to the 9 appropriate executive, legislative or administrative authority. 10 11 read: 12 SECTION 2. 16.765 (i) and (2) (a) of the statutes are amended to 16.765 (1) Contracting agencies of the state shall include in all 13 contracts executed by them a provision obligating the contractor not to discriminate against any employe or applicant for employment because of 14 15 16 age, race, religion, color, handicap, sex, physical condition, developmental disability as defined in s. 51.01 (5), sexual orientation as INSERT A defined in S. 111.32 (4s) or national origin and obligating the 17 18 contractor to take affirmative action Lob to ensure equal employment 19 opportunities. 20 21 22 23 24 25 (2) (a) In connection with the performance of work under this contract, the contractor agrees not to discriminate against any employe or applicant for employment because of age, race, religion, color, handicap, sex, physical condition, developmental disability as defined in S. 51.01 (5), sexual orientation or national origin. This provision shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment 26 27 28 including or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, Insert B apprenticeship. (2) It is believed by many students of the problem that protection by law of the rights of all people to obtain gainful employment, and other privileges free from discrimination because of age, race, creed, color, handicap, sex, national origia or, ancestry or sexual orientation, would remove certain recognized sources of strife and unrest, and encourage the full utilization of the productive resources of the state to the benefit of the state, the family and to all the people of the state. (3) In the interpretation and application of this subchapter, and otherwise, it is declared to be the public policy of the state to encourage and foster to the fullest extent practicable the employment of all properly qualified persons regardless of their age, race, creed, color, handicap, sex, national origin er, ancestry or sexual orientation. SECTION 17. 111.32 (5) (i) of the statutes is created to read: 111.32 (5) (i) It is discrimination because of sexual orientation: 1. For any employer, labor organization, licensing agency or employment agency or other person to refuse to hire, employ, admit or license, or to bar or terminate from employment, membership or licensure any individual, or to discriminate against an individual in promotion, compensation or in terms, conditions or privileges of employment because of the individual's sexual orientation; or 2. For any employer, labor organization, licensing agency or 21 employment agency or other person to discharge or otherwise discriminate 22 22 against any person because he or she has opposed any discriminatory 23 practices under this paragraph or because he or she has made a complaint, 24 testified or assisted in any proceeding under this paragraph. 25 26 22 SECTION 18. 111.70 (2) of the statutes is amended to read: 111.70 (2) RIGHTS OF MUNICIPAL EMPLOYES. Municipal employes shall 27 have the right of self rganization, and the right to form, join or assist 28 labor organizations gain collectively through representatives of --- 1981 -13- LRB-0124/2 KC. Every person affected by a rule shall be entitled to the same benefits and subject to the same obligations as any other person under the same or similar circumstances. SECTION 22. 230.01 (2) of the statutes is amended to read: 230.01 (2) It is the policy of the state and the responsibility of the secretary and the administrator to maintain a system of personnel management which fills positions in the classified service through methods which apply the merit principle, with adequate civil service safeguards. It is the policy of this state to provide for equal employment opportunity by ensuring that all personnel actions including hire, tenure or term, and condition or privilege of employment be based on the ability to perform the duties and responsib lities assigned to the particular position without regard to age, race, creed or religion, color, handicap, sex, national origin, ancestry, sexual orientation or political affiliation. If there are substantial disparities between the proportions of members of racial, ethnic, gender, or handicap groups in a classified civil service classification in an agency and the proportions of such groups in this state, it is the policy of this state to take affirmative action which is not in conflict with other provisions of this subchapter to correct the imbalances and to eliminate the present effects of past discrimination. INSERT It is the policy of the state to ensure its employes opportunities for satisfying careers and fair treatment based on the value of each employe's services. SECTION 23. 230.18 of the statutes is amended to read: 230.18 POLITICAL OR RELIGIOUS AFFILIATIONS; NO DISCRIMINATION. No discriminations may be exercised in the recruitment, application, examination or hiring process against or in favor of any person because of the person's political or religious opinions or affiliations or because of age, sex, handicap, race, color, sexual orientation national origin or ancestry except as otherwise provided. SECTION 24. 234.29 of the statutes is amended to read: 234.29 EQUALITY OF OCCUPANCY AND EMPLOYMENT. Capitol Madison, WI 53702 Subject: LRB-0124/1 relating to prohibiting discrimination on the basis of sexual orientation This memo is in response to your request that I, as drafter of LRB-0124/1, discuss the legal effect of the bill draft and its relationship to the criminal statutes prohibiting certain types of sexual activity. same manner LRB-0124/1 prohibits discrimination on the basis of sexual orientation in the areas of employment, housing and public accommodations, in the that discrimination is prohibited on the bases of race, sex, national origin, etc. The bill draft defines sexual orientation as having a preference for either heterosexuality, homosexuality or bisexuality, having a history of any of these preferences or being identified with any of these preferences. This definition is identical to the one used in the recently enacted Milwaukee ordinance relating to sexual orientation. By its very terms, the definition used describes the attitudinal preference of an individual or how the individual identifies him/herself or is identified by others. It should be noted that persons who have a preference for heterosexuality or identify themselves as heterosexuals are also protected from discrimination under the bill draft. LRB-0124/1 does not make any changes in chapter 944 of the Wisconsin statutes which is entitled "Crimes Against Sexual Morality" and prohibits certain types of sexual activity. This chapter prohibits, among other actions, sexual intercourse with someone who is not a person's spouse, cohabitation with someone who is not a person's spouse, public sexual activity or exposure and anal or oral sexual activity. None of these prohibitions are changed by LRB- 0124/1. Furthermore, in my legal opinion, the fact that a person is guaranteed the civil right to be free from discrimination in employment, housing and public accommodation would not prevent that person from being charged with a criminal offense under chapter 944 if he or she committed one of the specific activities prohibited by that chapter. The only changes in the laws administered by the Employment Relations Commission is the new provision adding "sexual orientation" to the existing list of prohibited forms of discrimination which, if proven, would provide a basis for suspending a union's fair-share agreement. See Sections 18, 19 and 20 of 1979 AB 70 amending Sections 111.70 (2), 111.81 (9) (b) and 111.81 (1) of Wis. Stats. Based on the Commission's current experience with the administration of these provisions, we anticipate that this bill, as currently drafted, will have an insub- stantial impact on our caseload. It is impossible to estimate the number of additional complaints which the Commission would receive, in the absence of any data regarding this pro- tected group. Over a six-year period the Madison Equal Opportunity Commission has received only 7 complaints based on sexual orientation, 1.2% of the total of 584 employment complaints. There is potential for a small increase in complaints. The financial impact will be minimal, since no additional staff will be employed to process these complaints. In the area of housing, employment and public accommodations, this bill provides essentially the same coverage regarding sexual orientation as a Madison city ordinance. It is anticipated therefore that the state's experience in terms of the percentages of persons filing charges based on sexual orientation as compared to total charges filed would probably be similar to that of the city of Madison. 2. The city of Madison over the past 5 years averages 2% of its housing cases and 1% of its employment cases based on sexual orientation. This would mean that in an average year, we might receive twenty such employment charges and one or less housing cases. 3. 4. It is assumed that this type of discrimination is more prevalent in the state than would be indicated by Madison's statistics since: a) Madison is somewhat more of a liberal minded community and hence probably not as likely to discriminate against persons on this basis. b) While many persons may be discriminated against because of their sexual orientation, these persons may fear attracting public attention to themselves by filing such a charge and thus do not file. Passage of this bill would only increase the division's workload by 1-2% and could be absorbed without permanently increasing appropriations. Sexual orientation is defined as having a preference for heterosexuality, homosexuality, bisexuality, having a history of such a preference or being identified with such a preference. The prohibition against discrimination also includes the state civil service, state contractors, the state national guard and the administrative rules promulgated by state agencies. For further information, see the state and local fiscal estimate which will be printed as an appendix to this bill. The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SECTION 1. 15.04 (1) (g) of the statutes is amended to read: ---
